What is a Medicaid Crisis Plan?

A Medicaid crisis is when a senior needs immediate nursing care services at home or in a facility but isn’t eligible for the program because their assets exceed the eligibility limit. At PB Elder Law, our experienced elder law attorneys can strategically change this situation by reducing countable assets to meet the requirements, while still ensuring you and your family get the benefit of your assets. But keep in mind, these strategies must be done within the legal framework governing Medicaid eligibility and can only be done by a licensed attorney.

Who does a Medicaid Crisis Plan protect?

A Medicaid Crisis Plan can make sure a Medicaid applicant’s family is not rendered destitute in order to pay for the care of their loved one.

A Medicaid crisis not only impacts the senior under skilled nursing care; their spouse and children can also be affected. For example, some of the assets belonging to a healthy spouse, also called a community spouse, are included among the countable resources of the applying spouse. 

If the healthy spouse has excess resources above the limit, they’ll be required to spend down unless they develop a legal Medicaid Crisis Plan. Without a Medicaid Crisis Plan, a spouse will end up losing assets over Medicaid’s very low limits.

Some resources are exempt from Medicaid’s resource limits, but most of them are not. There are several last-minute strategies that can be put into place for a Medicaid applicant, their spouse or other family members, which could save a person’s home, investments or other assets from being spent on Medicaid costs.
